Cancellations Policy

Once you have placed an order with Baildon bouncy castles you have entered into a contract, However we understand that cancellations are needed to be made from time to time, our cancellation terms are outlined below and are designed to be very reasonable. The policy is only in place to protect both our and your best interests and ensure that our out of pocket expenses are covered. It is not designed to be profitable on our part;

SPACE

Orders up to £64

Cancellations are accepted. All we ask is that you cancel the order before 12noon on the Friday before your event. Should your order be cancelled after 12noon on the Friday before your event or on the day of the event (including refusal of delivery on arrival) your order will be subject to a 100% cancellation fee (Reduced to 75% if paid within 7 days) to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of whether your event goes ahead or not. All payments made will be treated as a booking fee and not a deposit and as such, non refundable. Any cancellations made on site, after the entertainment has been erected or even semi erected will be subject to 100% cancellation fee. (No reduction is offered)

SPACE

Orders between £65 and £199

Cancellations are accepted but will be subject to a cancellation fee of £69.00 to cover bokking fee and administration. Cancellations made between 7 days in advance of the event and up until 12noon on the day before your event will be subject to a 100% cancellation fee (Reduced to 50% if paid within 7 days) to cover our costs. Should your order be cancelled after 12noon on the day before your event or on the day of the event (including refusal of delivery on arrival) your order will be subject to a 100% cancellation fee to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of whether your event goes ahead or not. All payments made will be treated as a booking fee and not a deposit and as such, non refundable.Any cancellations made on site, after the entertainment has been erected or even semi erected will be subject to 100% cancellation fee (Reduced to 75% if paid within 7 days)

SPACE

Orders between £200 and £399

Cancellations are accepted but will be subject to a cancellation fee of £99 to cover the booking fee and administration.. Cancellations made between 14 days in advance of the event and up until 12noon on the day before your event will be subject to a 75% cancellation (Reduced to 50% if paid within 7 days) fee to cover our costs.
Should your order be cancelled after 12noon on the day before your event or on the day of the event (including refusal of delivery on arrival) your order will be subject to a 100% cancellation (No reduction offered) fee to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of whether your event goes ahead or not.
All payments made will be treated as a booking fee and not a deposit and as such, non refundable. Any cancellations made on site, after the entertainment has been erected or even semi erected will be subject to 100% cancellation fee (No reduction is offered) All long-distance deliveries outside of our hometown may also attract a vehicle hire fee which will be payable on top of any cancellation charges.

SPACE

Orders over £400

Unfortunately all orders over the value of £400 are subject to a 50% cancellation fee regardless of when the order or cancellation is made due to the large amount of preparation and event management that will have taken place already that must be recovered. Should your order be cancelled after 12noon on the day before your event or on the day of the event (including refusal of delivery on arrival) your order will be subject to a 100% cancellation fee (Reduced to 75% if paid within 7 days) to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of whether your event goes ahead or not. All payments made will be treated as a booking fee and not a deposit and as such, nonrefundable. Any cancellations made on site, after the entertainment has been erected or even semi erected will be subject to 100% cancellation fee (No reduction is offered)

Cancellations on arrival due to not fitting, unsuitable locations or unacceptable ground conditions

All sizes, dimensions & ground types are clearly displayed on our website. Should we arrive on the day and the items not fit in your chosen venue or event area or the ground be deemed unsuitable, your order will be subject to a 100% cancellation fee to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of whether your event goes ahead or not. No exceptions. We will try our best to provide an alternative or accommodate the relocation of the entertainment, however, our event staff will only have a finite amount of time allocated to your booking and must keep a tight schedule in order not disrupt other bookings on that day. All payments made will be treated as a booking fee and not a deposit and as such, nonrefundable.

Cancellation of Generators

All generators are non refundable as they are hired in on your behalf. There is no course for Baildon bouncy castles to recover costs associated with the hire as payment is paid up front and in advance at the time of your booking on your behalf. Additional fuel charges are however 100% refundable.

Refusal of delivery (Including wet weather)

Should our team arrive at your venue and for whatever reason you cancel the booking your order will be subject to a 100% cancellation fee (Reduced to 75% if paid within 7 days) to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, fuel costs, vehicle & generator hire and staff commitments which will have to be paid for regardless of whether your event goes ahead or not. WET OR BAD WEATHER IS NOT A VALID REASON FOR TURNING US AWAY WITHOUT NOTICE AND THE CANCELLATION CHARGE WILL STILL APPLY. The only way in which to avoid a penalty is to provide our delivery team with a copy of your Cancellation Confirmation. Failure to pay on the day will result in your case being presented to Daniel Silverman Ltd as outlined below. A no-show is also treated as a refusal of delivery. Any cancellations made on site, after the entertainment has been erected or even semi erected will be subject to 100% cancellation fee (Reduced to 75% if paid within 7 days)

Pipa, Adips Rpii, Safety Testing & health and safety related cancellations

Please note that All PIPA/RPII & TEST related cancellations will be subject to a 100% cancellation fee (Reduced to 75% if paid within 7 days) Any cancellations made on site, after the entertainment has been removed from the vehicle(s) will be subject to 100% cancellation fee (Reduced to 75% if paid within 7 days) NO EXCEPTIONS.PACE

PIPA/RPII is commonly misconstrued as the law and PIPA is not the law.PIPA is merely a brand that we choose not to use. The brand we choose to use is Betterbounce Direct in Leeds. Whilst we do not participate in the Pipa Scheme directly due to it not encompassing our entire entertainment stock, For added assurance, Our Director is on the panel of the PIpa Inspection Body/ Leadership PLG scheme who regulate the industry. Pipa tested inflatables are available from £200+vat per item should they be required at your event. Sadly Pipa only cover inflatables designed to be used by children under the age of 14, who's primary use is for bouncing and sliding, As such only 22% of our items fall within the scope of Pipa and as such we opt to use a scheme witha much wider scope. The ONLY legal requirement for the safety inspecting of bouncy castles and inflatables is to comply with The Provision and Use of Work Equipment regulations 1998 (PUWER).

Pipa is NOT the law - PUWER IS the law!

This states that you MUST HAVE an annual inspection carried out by a competent person. The HSE themselves do not and will not officially recommend any specific body. All they specify is if the test was carried out by a competent person and as such we use the brand BETTER BOUNCE DIRECT

As part of this testing, The tester must be able to demonstrate that the inflatable is manufactured in accordance with the latest BS/EN14960 Regulations, which ensures inflatables are safe in design and manufacture, are Flame retardant and fit for purpose as well as ensuring the inflatables are in a good state of repair. PIPA testing is therefore not the law, whereas the company’s adherence to PUWER is the law.

SPACE

PIPA is simply a brand of testing and despite popular belief, not compulsory. This confusion is lead mainly by PIPA being one of the first bodies to offer testing of inflatables and has become a household name in the same way we use the word “Hoover” when in fact we are referring to the “Vacuum Cleaner” or the word “Tannoy” when we are referring to a public address system (PA).

SPACE

One of the main reasons we do not use PIPA is that PIPA is only in place to reflect the safety of bouncy castles & inflatables designed solely for Bouncing & Sliding and not really adequate for a company as large and diverse as ourselves. Gladiator Duels, Assault courses, Bungee Runs, Knock out inflatables, Pillow bashes, Bouncy Boxing, Human table football, Human Bowling and most of the other items on our website do not qualify for testing by PIPA.

In absence of any further laws we opt not t use the brand Pipa and use the brand BETTER BOUNCE DIRECT, We do this because of the following reasons:

  • The company has been around for over 25 years gaining an almost Unrivalled level of competence.
  • They issue safety inspections certificates independently that comply with PUWER.
  • The company issue every inflatable with a unique serial number to enable tracking even after sale.
  • Each certificate comes with a log book and a service history section so you can track its history (like a car)
  • They are members of The British Inflatable Hirers Association (BIHA)
  • They are members of The Inflatable Play Enterprise (TIPE)
  • They have completed The Registered Play Inspectors International training day.
  • They are open 7 days a week for verification of certificates on 0113 2574483 or by email on:betterbounceebay@gmail.com

More importantly, ALL our inflatables are tested to en14960 by Betterbounce Ltd Annually and we have a complete record of in-house weekly testing and maintenance schedules. To view our test, please email us and we will be happy to provide you with our records.

I must also point out that we are fortunate enough to have had our Health and Safety & testing regime inspected by the HSE themselves and they are 100% happy with our proceedings.

General terms applicable to all cancellations

ALL Cancellations must be made in writing via letter or email regardless of how the entertainment was booked and within the timescales outlined above. Cancellations left on a voice mail are not acceptable as they may not be picked up until after your event. You must speak with a human being during normal working hours (Mon-Fri, 9am - 5pm). Failure to do so may result in a cancellation charge.

Due to the high number of fraudulent cancellation claims, we must make it fully clear that sending an email or letter to us is not proof of delivery. In the case of email, If no confirmation is received from us within 24hrs & in the case of a letter, no response is received within 10 days, please contact us immediately via telephone to verify your request has been received. If no verification can be proved or cancellation number produced then you will still be charged the appropriate fee as outlined above.

No cancellation is final until we have sent you a cancellation notice via email. If you haven't received the email please call us for verification in order to avoid disappointment and charge.

A SENT EMAIL IS NOT PROOF OF CANCELLATION.

All booking amendments will be treated in the same manner as cancellations. The cancellation fees apply to the original booking price only. Amending a package to a lesser amount will not eradicate the cancellation charge and the highest fee will be applicable.

Please Note: All cancellations are issued with a unique cancellation number for verification purposes. Please keep this number safe in the event that you be required to prove cancellation. Any cancellation claims made without a cancellation number will still be subject to a charge as this is the only proof of cancellation being made with an actual human being and not an answer/ email service that could not be picked up in time for your event. Failure to produce a cancellation number in a dispute will result in a cancellation fee in line with the cancellation terms above. Please note that we never ever take provisional bookings.

Legal Action:*Failure to adhere to the payment terms & conditions will result in your file being passed over to Daniel Silverman Ltd for action. Daniel Silverman (Reg Company number 3998129) is a dedicated debt recovery agent that will act on our behalf to recover any outstanding payments and will represent us in the event of court proceedings taking place. Daniel Silverman Ltd are members of the Credit Services Association (CSA) are Registered with the Data Protection Agency (Reg NoZ08889433) and are licensed by the Consumer Credit Act (Licence No 572341 - Issued by the office of fair trading) Should Daniel Silverman Ltd be instructed to act on our behalf, they will automatically increase the outstanding balance of this invoice by 15%

Please do not book with Baildon bouncy castles unless you agree to be bound by these terms & conditions above
